1. Acceptance of these Terms & Conditions
SPACE4 provides you with access to the SPACE4.com.au site subject to the terms and conditions of use set out below. You agree to read the Terms & Conditions carefully prior to using the site or its services, or becoming a member. By using the site and its services you agree to abide by the Terms &Conditions as below.
SPACE4 may from time to time amend these terms and conditions so it is important that you revisit this page regularly. Amended Terms & Conditions will be effective immediately upon posting to the site.
Your access to, and use of, this Site will be governed by these terms & conditions whether or not you choose to become a member.
2. Fees
You are able to post your profile to SPACE4 free of charge, however should you wish to contact other members by email you will need to become a member. Membership is provided for a fee of A$9.95 for 21 days, A$24.95 for 90 days or A$49.95 for 12 months. You are responsible for paying any applicable fees and taxes for all hardware, software and other costs you may incur in connection with the services, including costs incurred connecting to the site via the internet. SPACE4 reserves the right to amend any or all of the membership fees. SPACE4 will notify you of any such changes by posting information on the site.
If you are making membership payment by credit card, your card will automatically be charged. SPACE4 does not store your personal credit card information.
If you wish to register as a Member, You must pay the membership fee using our online payment system. SPACE4 uses military strength encryption to keep credit card numbers safe during the payment transaction.
3. How do I become a member>
You must be a member to use the services of the Site. You are able to become a member by accepting the Terms and Conditions, acknowledging the Privacy Statement and by registering online. Members must be aged 18 and over. Parents must pay the selected fee as per above to become a member.
4. How the site works.
The site consists of public and private areas.
Public areas are viewable by all users. Non members are able to perform a trial search of members' profiles and to access generic resources (like the FAQ and Resources sections). Only members are able to access the private areas of the site.
Private areas of the site include the ability to view full Members profiles, excluding personal addresses and phone numbers, and the Premium Members Area. Members can choose to email other members to introduce themselves via the SPACE4 site initially. Once members have made contact, they may choose to exchange personal phone numbers and addresses.
5. What the site offers
SPACE4 offers Parents the ability to search for other parents in their chosen area online. By becoming a member, you acknowledge that the site merely offers you the opportunity to make contact with other parents based on specific search credentials. SPACE4 does not complete police or other background checks, nor does it verify the information posted by other members.
As a result SPACE4 highly recommends that members interview each other by telephone before scheduling a first face to face meeting to ensure that they choose the best match for them. Parents should check the requirements provided by any relevant legislation in their State. Parents are responsible for ensuring that they have complied with the relevant legislation and obtained any required background checks.
6. How to register
Parents can join the Site by completing the Membership registration online. This entails posting a profile of your personal details including, but not restricted to, name, address, date of birth, houseshare and childcare preferences. All the information collected is stored securely, and by becoming a member you acknowledge that your personal information may be displayed on this site. Your name, address, telephone number and email address will not be made available for general viewing by other members. Please make yourself familiar with our Privacy Policy for further details.
7. Member Conduct / Prohibited Use
You are prohibited from any actions that may interfere with another's experience. These include, but are not limited to
> Using our systems to send unsolicited messages (SPAM)
> accessing data not intended for You
> attempting to breach authentication or login to an account that you are unauthorized to access
> disrupting service to the Site by interfering with the server or network by denial of service attack (DOS), spamming, or otherwise engage in conduct that causes a threatened or actual nuisance to Site Members.
> Forging information sent to the website or in an email, including TCP/IP packet information.
If you become Site Member, you are participating in the site community. You must conduct yourself in a manner that is in the spirit of the community. You must not post, transmit, save, or distribute any Information or material that:
> Is false, inaccurate or misleading; is ambiguous; is fraudulent;
> infringes upon the copyright, trademark, patent, trade secret, or other intellectual poperty of any third party;
> is illegal, or advocates or encourages any illegal activity;
> defames, is discourteous, racially offensive, abusive, libelous, threatening, or intimidating;
> is obscene, indecent or contains child or other pornography;
> violates the privacy of individuals, including other users of the site;
> treats the site as a dating site;
> contains any viruses, Trojan horses, worms, cancelbots, time bombs or other disabling devices or computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or personal information;
> create liability for us or cause us to lose (in whole or in part) the services of our ISPs, Web hosting company, or other suppliers; or
> creates an unauthorized link to another website; or
> violates any applicable local, state, national or international law.
SPACE4 shall use its discretion in determining your compliance with the guidelines and reserves the right to edit, refuse to post, or remove any Information or material it deems as inappropriate, without prior notice. In the event of this occuring, and/or any information or profile or membership being suspended due to violation of any of our terms and conditions, no refund of fees will be made.
A A$10,000 advertising surcharge will be billed to any individual or roommate service provider; including but not limited to employees, affiliates, consultants or partners or roommate service providers that subscribes to, lists of references a competing houseshare service provider in their profile on SPACE4.com.au or any of its affiliates without prior written approval from SPACE4.
8. Acceptance of Risk, Disclaimer and Release from Liability
In using this Site, you accept that there are risks associated with dealing with people you have not met before and using the information provided on this Site.
SPACE4 disclaims all responsibility for material and Information posted on this Site and all liability (including without limitation, liability in negligence) for all expenses, losses, harm, damages or costs you incur as a result of your use of this Site.
In using this Site, you acknowledge that SPACE4 makes no warranties or representation as to the quality, accuracy or completeness of the Information provided by other members. You also acknowledge SPACE4 does not have any control over or responsibility for the actions of its members and makes no warranties as to their behaviour.
In the event that you have a dispute with another member you will need to personally negotiate the resolution of that dispute. SPACE4 will not be held responsible for any liability relating to inter member disputes of any kind.
You release SPACE4 (and its officers, directors, agents, affiliates, subsidiaries and employees) from claims, demands and damages (including actual, special, direct, indirect and consequential damages) arising directly or indirectly out of or in any way connected to
> disputes with or acts or omissions (including negligence) of other members;
> your reliance upon Information; or
> Your use of this Site generally.
SPACE4 makes no warranty, representation or guarantee that use of the site, the services or the information will be uninterrupted, secure, virus free or error free or that any defects can be corrected. SPACE4 does not personally endorse any member who lists on the site, and makes no representation as to individual character, credit history, rental history or reliability. SPACE4 cannot be held responsible for any events or adverse consequences that arise through the use of our services, or by contacting other members. It is each member>s responsibility to determine the character and trustworthiness of any other member.
9. Copyright
The content of this Site is protected by Australian and International copyright and other intellectual property laws. You are authorised to copy or download material on this Site for your personal use however you may not do so for commercial or public purposes.
The SPACE4 logo and domain name are trademarks of SPACE4. No permission is given to reproduce the SPACE4 logo, and you may only create a link to this Site after first having gained SPACE4>s express permission in writing. All information contained in this site (with the exception of acknowledged third party links or articles) is the property of SPACE4 and is prohibited from being reproduced in full or in part by any other entity or individual, either for commercial or non-commercial purposes.
10. Links to Third Party Sites
Access to any other third-party Internet sites linked to this Site is at your own risk and SPACE4 accepts no responsibility or liability for the accuracy or reliability of any content, information, data, opinions, advice or statements made on such sites. SPACE4 provides these links merely as a convenience and does not intend such links to be a referral to or endorsement of the linked third-party sites or the entities that operate them.
11. Representation
You represent and warrant that you have full right and power to enter into the Terms & Conditions, that all factual assertions that you have made and will make to SPACE4 are true and complete, and that you have the right to enter into legally binding agreements, and have the full and complete right to agree to the Terms & Conditions.
12. General
Your use of this Site will be governed by and construed in accordance with the laws of NSW and you agree to submit to the jurisdiction of that State.
Any failure by SPACE4 at any time to enforce any of the provisions of these terms and conditions or any of its rights will not be a waiver of such provisions, rights or elections or affect the validity of these terms and conditions.
If any clause or part of a clause of these terms and conditions is invalid, illegal, unlawful or otherwise being incapable of enforcement, that clause or part of a clause will be deemed to be severed and of no force and effect but all other clauses and parts of clauses of these terms and conditions will nevertheless prevail and remain in full force and effect and be valid and fully enforceable. No clause or part of a clause of these terms and conditions will be construed to be dependent upon any other clause or part of a clause unless so expressed.
13. Termination
SPACE4 may terminate your membership at any time in its absolute discretion, for any or no cause, without notice of termination to you if (a) you breach the Terms & Conditions (b) you infringe the intellectual property rights of a third party in connection with the services (c) SPACE4 is unable to verify or authenticate the information you provide. In this event no refund of fees paid will be given.
14. Mailing List
Please note that by becoming a member of SPACE4, whether basic, bronze or premium, or by submitting your email address on site for the free report, that you are giving SPACE4 permission to include you on our database mailing list. We may from time to time send you communications and emails which at any time you may request to terminate your subscription to.
15. Refund Policy
Should the service provided by SPACE4 be inaccessible or unavailable due to technical problems for a period equal to or longer than 25% of your membership period, SPACE4 will refund a pro rata rate of your fee paid upon joining. This does not apply to basic membership which does not incur a fee.
